These terms apply to everyone who joins the FinKut partner program. The program pays commission only; there are no fees, advances or fixed payments.
Who we are and how these terms apply
The partner program is run by FINKUT LLC, 30 N Gould St Ste N, Sheridan, WY 82801, USA (“FinKut”, “we”). By applying to the program and accepting these terms you (“partner”, “you”) agree to them. You act as an independent contractor: nothing here makes you our employee, agent, partner in a legal sense or representative, and you may not make promises or sign anything on our behalf. Our Terms of Service and Privacy Policy also apply to your use of FinKut.
Joining the program
You must be at least 18 years old and give accurate information in your application. We review applications individually and may accept or decline any application without giving a reason. You may not join if you, or the people you act for, are subject to sanctions or live in a country or region under comprehensive sanctions, and you must tell us if that changes. Each person or company may hold one partner account.
Your link, your code and who a customer belongs to
We give you a personal link and, where available, a discount code for your audience. A new customer is credited to the first partner whose link or code they used: a link is remembered for the attribution period shown on the program page, and a code counts on the customer’s first payment. A later link or code does not move a customer to another partner. People who already had a FinKut account before using your link are not credited. You may not refer yourself, your own accounts or accounts you control.
Commission
You earn the commission rate shown on the program page on each payment a customer you referred makes during the commission period shown there, counted from that customer’s first paid invoice. Commission is calculated on the amount the customer actually paid, after discounts and excluding taxes. Free trials, unpaid invoices and payments outside the commission period earn nothing.
We may change the rate or the commission period for the program. A change applies only to commissions created after it takes effect; commissions already created keep their rate. We will tell you by email at least 30 days before any reduction.
Holds, payouts and minimums
Each commission is held for the period shown on the program page so that refunds can be settled, and is then confirmed. Confirmed commissions are paid once a month, in US dollars, once your balance reaches the minimum shown on the program page; smaller balances carry over. We use Rewardful, an independent partner platform, to track referrals and commissions and to send payouts: you get your own Rewardful dashboard and set up your payout method there. If we move to another payout provider, we will tell you by email. Fees charged by your bank, payment service or for currency conversion are yours. We may hold a payout until you have provided the payout, identity and tax information we or our payout provider ask for.
Refunds, chargebacks and corrections
A payment that is refunded, reversed or charged back earns no commission. If this happens after the commission was paid, the amount is deducted from your future payouts. A negative balance that is not cleared within 12 months is written off and we will not ask you to repay it, except in cases of fraud or a breach of these terms. We may correct commissions that were created in error.
How you may promote FinKut
Clearly disclose that you earn commission wherever you share your link, code or a recommendation, close to the mention itself, in a way your audience will notice: for example “paid link”, “Ad” or “Werbung/Anzeige”, and in videos both on screen and spoken. Follow the advertising and consumer-protection rules that apply to you, including the U.S. FTC Endorsement Guides, the German UWG and the UK CAP Code.
FinKut is a research tool, not investment advice. Do not present FinKut, or anything shown in it, as a recommendation to buy or sell a security, do not promise returns or results, and describe FinKut’s features accurately.
What is not allowed
You may not:
- refer yourself or share your commission with customers through cashback, rebates or similar incentives;
- bid on “FinKut” or similar spellings in paid search, or run ads that send traffic straight to FinKut, without our written consent;
- use “FinKut” or a confusingly similar name in a domain, app or social media account name;
- publish your code on coupon, deal or cashback sites without our written consent;
- send spam, use fake reviews, set cookies without a real click (cookie stuffing) or use any misleading or deceptive method;
- post your link in communities that do not allow it, such as many Reddit or forum communities; or
- give personal investment advice in FinKut’s name or say you speak for FinKut.
Commissions earned through a prohibited method are not payable.
Your FinKut access
Approved partners receive free access to a paid FinKut plan for the period shown on the program page, to research and create content about FinKut. The access ends when that period runs out unless we extend it in writing; it also ends when the partnership ends. It is for your own use, may not be shared or resold, and earns no commission.
Using the FinKut name and materials
While you are a partner, you may use the FinKut name, logo, screenshots and materials we provide, only to promote FinKut under these terms and without changing them. This permission ends when your partnership ends, and we may withdraw it at any time.
Our review of your content
We may review public content in which you promote FinKut. If something does not meet these terms, we may ask you to correct or remove it within a reasonable time. Serious or repeated breaches can lead to suspension or termination.
Taxes
You are responsible for your own taxes on the commission you receive. If you are a U.S. person, we may ask for a Form W-9 before paying you; if you are not, we may ask for a Form W-8BEN or W-8BEN-E. We may withhold payment until a required form is provided, or where the law requires us to.
Ending the partnership
You or we may end the partnership at any time by email. After it ends you may no longer promote FinKut as a partner. If it ends for a reason other than a breach of these terms, commissions on customers you referred before the end continue under these terms until their commission period runs out. If it ends because of a breach, commissions not yet paid are forfeited.
Privacy
We process the information you give us, such as your name, email, channel details, payout and tax details, to run the program, pay you and meet legal duties, as described in our Privacy Policy. Our partner platform (Rewardful) and payout providers process this information on our behalf. We do not share the personal data of customers you referred with you; you see aggregated figures only.
No guarantees and limits of liability
We do not promise any level of earnings. We may change, pause or end the program; if we end it, commissions already earned will still be paid under these terms. To the extent the law allows, our total liability to you under the program is limited to the commission paid to you in the 12 months before the claim.
Changes and governing law
We may update these terms. We will tell you about material changes by email at least 30 days before they apply; continuing in the program after that date means you accept them. These terms are governed by the laws of the State of Wyoming, USA, without prejudice to any mandatory rights you have where you live. Questions: finkut@finkut.com.
