These terms apply whenever you use FinKut.
Agreement and eligibility
FinKut is provided by FINKUT LLC, 30 N Gould St Ste N, Sheridan, WY 82801, USA (“FinKut”, “we”). These Terms set out the rules for using FinKut, including its company research, filing, financial data, news, watchlist, charting, file analysis, and AI-assisted features. By opening an account or using FinKut, you agree to these Terms and our Privacy Policy.
You must be at least 18 years old and legally able to enter into this agreement. Please keep your account information accurate, protect your login details, and let us know if you think someone else has accessed your account.
Product scope and availability
FinKut is a research workspace, not a trading venue. It brings together public filings, licensed market data, news, calculations, saved research, and AI-generated explanations. Coverage, history, model behavior, limits, pricing, and features will change over time. We work to keep the platform reliable, but we cannot promise uninterrupted access or complete coverage of every company, security, filing, or metric.
Acceptable use
Use FinKut for lawful research and informational purposes. Please do not:
- try to access another person’s account or data;
- probe, attack, overload, reverse engineer, or bypass the platform’s security;
- scrape, bulk-download, resell, or redistribute data in breach of a provider’s terms;
- use data or outputs from FinKut to train or evaluate machine-learning models, or to build a competing data product;
- upload malware, unlawful content, or information you are not authorized to share; or
- use FinKut to violate law, sanctions, third-party rights, or market-data licenses.
Your research and AI-assisted features
You remain responsible for the files, prompts, watchlists, notes, and other material you submit. We use that material only as needed to provide, secure, and improve the feature you asked for.
FinKut can use automated systems to extract, compare, summarize, classify, or explain information. Those outputs may contain errors, missing context, stale data, or conclusions that are not supported by the source. Check the source documents and calculations before relying on an answer. Do not enter confidential information unless you are authorized to do so.
Plans, billing, cancellation, and refunds
Seller. Paid plans are sold through Link, the Merchant of Record operated by Stripe (Stripe Managed Payments). Link processes your payment, calculates and remits sales tax, VAT, or GST, issues your receipts and invoices, and offers payment support; Link’s terms and privacy policy, shown at checkout, apply to the purchase. The charge appears on your statement as “LINK.COM* FINKUT”. Your card details go to Stripe and never reach our servers. Access to a paid plan begins once the payment is confirmed.
Renewal. Subscriptions renew automatically at the end of each billing period (monthly or yearly) at the price shown at checkout until you cancel. If a plan starts with a free trial, the first charge is made when the trial ends unless you cancel before then. We may change prices for future periods; we will tell you before a change applies to your renewal.
Cancellation and plan changes. You can cancel at any time from Settings → Subscription. Cancellation stops future renewals and your paid access continues until the end of the period you have paid for. Upgrades apply immediately; downgrades take effect from the next billing period.
Refunds. Your first payment for a subscription comes with a 14-day money-back guarantee; our Refund Policy sets out the details. Renewal payments are not refundable and we do not provide refunds or credits for partly used periods, unless the law where you live requires otherwise. Consumers in the European Economic Area, the United Kingdom, Switzerland, Turkey, and some other countries have a statutory right to cancel and receive a refund within 14 days of the first payment for a subscription (shorter periods apply in a few countries). To request a refund, contact us or use Link’s order support from your receipt. When a payment is refunded or charged back, the paid access it bought ends.
Electronic communications
When you create an account, use the Service, or contact us, you agree that we may communicate with you electronically about your account, security, billing, service changes, and support. Electronic notices satisfy any legal requirement that the notice be in writing, except where applicable law requires another form.
Your content and feedback
You keep your rights in the research notes, prompts, files, and other content you submit. You give us the limited permissions needed to host, process, display, and back up that content to provide the feature you requested. You represent that you have the rights and permissions needed to submit it. If you send feedback, you allow us to use it without payment or a duty to keep it confidential.
Intellectual property
The Service, its software, visual design, trademarks, and original content are owned by or licensed to us. Except for the limited right to use the Service under these Terms, no ownership rights are transferred to you.
Third-party services and data
FinKut may link to or depend on third-party services, data feeds, filings, news sources, payment providers, cloud infrastructure, and AI services. Their availability, terms, licenses, and privacy practices are outside our control. Your use of those services may be subject to their terms, and you must not use FinKut to defeat a source provider's access limits or license restrictions.
Suspension and termination
We may limit, suspend, or terminate access if we reasonably believe an account creates security, abuse, legal, payment, or operational risk, or if these Terms are violated. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
No professional advice; disclaimers
FinKut provides research and information tools. It is not a broker-dealer, investment adviser, fiduciary, financial planner, tax adviser, or legal adviser, and the Service does not provide a recommendation tailored to your circumstances. Nothing on FinKut is an offer, solicitation, or promise of investment results. See our Financial Disclaimer.
To the fullest extent permitted by law, the Service is provided on an “as available” and “as is” basis, and we are not responsible for indirect, incidental, special, consequential, or lost-profit damages arising from use of the Service.
Limit of liability and your responsibility
To the fullest extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of the fees you paid for the Service in the 12 months before the claim arose and USD 100. This limit does not apply to liability that cannot be limited by law.
You are responsible for your use of the Service and for the decisions you make with it. If a third party brings a claim against us because you broke these Terms or the law while using the Service, you agree to cover the reasonable costs and damages that result.
Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. The state and federal courts located in Wyoming have exclusive jurisdiction over disputes arising from these Terms or the Service, and you and FinKut consent to those courts.
If you use the Service as a consumer, nothing in these Terms removes rights that the mandatory law of your country of residence gives you, including the right to bring a claim in the courts of that country. A separate written agreement for a commercial or enterprise plan may state different terms.
Questions about these Terms: support@finkut.com or the Contact page.
General terms
If a court finds part of these Terms unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. You may not assign your account or these Terms without our consent; we may assign them as part of a reorganization, financing, or sale of the Service. We are not responsible for delays caused by events outside our reasonable control.
Changes to these Terms
We may update these Terms when the Service or legal requirements change. The current version and effective date will be posted on this page. Where a change materially affects existing users, we will provide notice through the Service or by email where appropriate.
